Read How Tree Selection and Location Influence Tree Risk Assessment in the Urban Area

Due to the close proximity of trees in the urban landscape, tree failures often result in personal injury and/or property damage.  What the cause or why a tree failed is an important factor in tree accidents and related lawsuits.  

The damage caused by a tree part or whole tree failure resulting from an extreme climatic event such as a hurricane or tornado may be viewed and defended as an "Act of God", a natural, unavoidable or unforeseeable catastrophe that interrupts to expected course of events.  However, with increased understanding of tree mechanics, biology and structure, tree hazards and inherent risks can be identified and a prescribed course of action can reduce the tree risk.

Property owners are liable for the trees on their property.  It is an owners' legal "duty of care" to properly inspect and ascertain if their trees may be causing a foreseeable problem or risk.  When an owner identifies a possible hazardous tree condition, they recognize their responsibility to have a tree professional perform a tree risk assessment.

Tree risk assessments are undertaken when an owner recognizes that their tree(s) have potential to cause damage or injury.  The assessment is intended to:

• limit the amount of risk to people in the vicinity of trees.
• limit the amount of risk to important property in the vicinity of trees.
• limit the amount of risk associated with owning trees.
• identify the highest risk trees that require immediate attention.
• recommend actions required to reduce the risk to an acceptable level.

Mr. Rappoport writes about the importance of tree selection and location in the urban landscape, and how a good tree in the wrong location can become a "risky" tree as it ages and matures.  

"Far too often, the tree selection fails to properly match the cultural growth requirements of a tree with the correct location. Somewhat like trying to pound a square peg into a round hole. Since trees are long-lived organisms, the growth characteristics that make a tree unsuitable for a location do not manifest for ten or twenty years.

Homeowners typically make the mistake of not understanding the growth characteristics of trees. Or, they assume the tree wiil not be around twenty or thirty years later. So, a small pine tree planted near the neighbors property line doesn’t become a problem until two decades later when the tree roots encroach into the neighboring residence and the tree crown extend over the property line. These conditions create tree hazards that increase the risk and potential liability to property owners. "

QUINN-direct Nationwide Survey Reveals a Number of Intersting Stats

PRLog (Press Release) - Aug 09, 2011 - One in three people admit to being a passenger in a car while the driver was under the influence of drugs or alcohol, QUINN-direct nationwide survey finds

A nationwide survey of 1000 adults commissioned by QUINN-direct Car Insurance Ireland has revealed that over a third (36%) of Irish people has been a passenger in a car where the driver was under the influence of drugs or alcohol. Males, those aged 45+ and living in Connaught or Ulster are most likely to be the offenders.  People aged 35-44 and living in Dublin were least likely to be under the influence of drugs and alcohol.

The survey found that one in five people admit to having driven a car while under the influence of drugs or alcohol. Once again, this figure is significantly higher amongst men (28%) and those over the age of 45 (26%). Women (10%) and people aged 16-24 (7%) were least likely to have driven under the influence of drugs or alcohol.  Munster people were more likely than those in any other province to have driven while under the influence (21%).

Almost three quarters of the Irish population have experienced anger or rage while driving
The research, which tested Irish people’s attitudes to driving and their driving habits, highlighted that the majority of Irish drivers (71%) experienced anger or rage whilst driving. A large percentage of men (78%) say they have experienced rage or anger behind the wheel and a significant percentage of women felt the same (64%). Incidences of rage are highest amongst those aged 24-44 but affected people around the country irrespective of location.

Over a half of Irish adults continue to use their mobile phone whilst driving
Over half (52%) of Irish adults said they used their mobile phone while driving to make or receive calls (without the use of a headset/bluetooth). Females were slightly more likely (34%) than men (32%) to use their phone while driving and those in the 35-44 age group were most likely to be the offenders (64%).

Two thirds of Irish drivers have broken the speed limit in the last 12 months
Two thirds of Irish drivers admit to having broken the speed limit in the last 12 months (66%). 75% of men and 66% of females admitted they had broken the speed limit – 73% of those in Munster compared to 64% in Connacht and Ulster, and 65% in Dublin. Those aged between 35 and 44 were most likely to have broken the speed limit.

1. Don't use your mobile phone whilst driving
Making or receiving a call, even using a hands-free phone, could lead to an accident.

2. Belt up in the back
In a collision, an unbelted rear seat passenger can kill or seriously injure the driver or a front seat passenger.

3. Alcohol, drugs and driving
Alcohol and both illegal and prescription drugs (including cold remedies) can impair your driving. It is never ok to drive when you have taken drugs. Be a safe driver and don't drink and drive.

4. Slow down
Take extra care outside schools and parks and other places where there may be more pedestrians around. Don’t forget children often act impulsively and many will be “trick or treating” this Halloween.

5. Take a break
Tiredness is thought to be a major factor in more than 10% of road accidents. Plan to stop for at least a 15 minute break every 2 hours on a long journey this bank holiday.

6. Anticipate
Observe and anticipate other road users. Use your mirrors regularly and don't forget to glance into your blind area before altering your course.

7. Use child seats
Child and baby seats should be fitted properly and checked every trip.

8. Keep your distance
Always keep a safe distance from the car in front.

9. Check your tyres
With the weather changing, it is important to ensure that your tyres are roadworthy for winter.

Changes to NJ PIP Auto Insurance System Under Consideration

NJ PIP Auto InsurancePRLog (Press Release) - Aug 09, 2011 - According to a report published in The Asbury Park Press, the New Jersey legislature is trying to find ways to deal with the rising costs of insurance premiums in the state. Rising rates are thought to be a contributing factor in the rising number of uninsured motorists across the United States.

A statement released by Marshall McKnight, spokesman for the New Jersey Department of Banking and Insurance, says that 97 percent of requested insurance rate increases are a result of personal injury protection (PIP).  The state legislature is considering a few changes to the PIP system which would decrease rates when you get a car insurance quote (http://www.getacarinsurancequoteonline.com). These changes would reduce insurance companies costs by lowering the fees paid to same-day surgery centers, reducing payment levels to alternative providers like chiropractors, and imposing caps on attorney's fees in arbitration cases. The changes would stop the use of ''diagnostic tests or practices that are not from evidence-based, clinical guidelines published in peer-reviewed journals.'' The legislation is based on sound logic. Breakdown Britain - Mortorist Shun Car Safety

PRLog (Press Release) - Aug 09, 2011 - Almost four out of ten (39 per cent) motorists do not know how to carry out any basic vehicle safety checks, reveals a survey out today by Quinn-direct, the young drivers insurance specialist.

The research reveals that out of the seven most common warning lights on a car dashboard, a staggering 65 per cent of motorists wouldn’t recognise any of them. This is particularly disappointing given that almost a quarter (22 per cent) admit that they don’t carry their vehicle handbook in the car with them.

Breakdown Britain’s top motoring mishaps include:

•   A quarter (23 per cent) of motorists don’t know how to check their car tyre treads
•   One in five (20 per cent) wouldn’t recognise the engine warning light if it came on
•   Almost one in five (18 per cent) don’t know how to check their tyre pressure
•   16 per cent of motorists don’t know how to check that their engine oil level is correct.

Given the low level of knowledge about warning lights and general car maintenance, it is disappointing that one in five (20 per cent) of UK drivers do not have breakdown cover. Cheap car insurance for young drivers may often contain certain cover so it’s always worth checking your policy first.

Men tend to be more switched on than women when it comes to knowing how to repair their cars – 80 per cent of women said that they have no idea how to carry out any safety checks or basic maintenance on their cars, compared to just 36 per cent of men.

Older is not necessarily wiser - almost a third of over 55s (30 per cent) say that they don’t think that they need breakdown cover, compared to only 16 per cent of 25-34 year-olds.

A Changing Ford Focus

Bold words, eh? Ford, is kicking off its re-imagined Focus with a fresh new advertising campaign. The idea itself may be simple – “drive it!” – but the level to which they’re taking this concept is unique, unusual, and (above all) innovative.

Prospective buyers are thrown right into a videogame-like experience. They pilot the car on a makeshift track in an exciting test of speed and accuracy. Curved roads and cone slalom runs pit the vehicle’s handling against the skill of the driver. Challenges make use of the Focus’ new hardware – everything from the rearview camera to its front grille sensor. Drivers are “graded” based on points, and points are gathered from lasers on the underbody of the car. That’s right. Lasers.

Bull’s-eyes are placed on the driving track to better measure the preciseness of maneuvers. When a driver directs the Focus over a target full-on, the underbody lasers trip a censor and a quick guitar riff and a series of cheers fills the car. Were the driver to miss one, the reaction is less positive – groans and sighs. It gives the whole experience a high-energy feel.  

That’s not all, though. A “lipstick” camera is placed on the rearview mirror as well, documenting the entire experience of the driver – every smile, every laugh, every frantic spin of the wheel. Once concluding the test, drivers have the option of posting their videos to Facebook, or Twitter.

By creating a uniquely interactive and shareable experience, Ford means to take its own excitement at the newly designed Focus, and bring it to the masses.

Although its European counterparts have been creating buzz, America hasn’t seen a “new” Focus since 2004. The United States has been skipped over in past years, but 2012 promises to change things. Ford wants to take an aggressive bite out of the global market, showing young buyers that this Focus is a compact urban runaround to contend with.

Standard Life reveals Brits tend to miss bargain investments

Long-Term Care Insurance Trade Group Campaign Encourages Employee Education

"More employers are offering long-term care insurance as a benefit to employees, family members and even retirees," explains Jesse Slome, executive director of the national producer trade group.  "Conventional wisdom says that group insurance policies cost less than a policy you could purchase on your own but that is not always true for long-term care insurance."

According the the Association recommendations, with employer-offered long-term care insurance there are important factors consumers need to evaluate.  "By doing careful comparison shopping, you might find you are able to get equal or even better coverage for less money," Slome acknowledges.  "A 55-year old couple could pay 25 percent less according to some current analysis."

Over eight million Americans have long-term care insurance purchased either on an individual basis or through a group plan according to AALTCI's 2011 Long-Term Care Insurance Sourcebook.  "Employers offering the coverage, typically on a voluntary basis, have been doing great work at expanding awareness for the importance of planning," Slome adds.  "They are making coverage available to millions and offer coverage to many who might never health qualify for traditional individual long-term care insurance policy."

La lluvia ha dificultado la progresión de Barragán en un circuito muy complicado, concluyendo 11º en la primera manga, y 10º en la segunda.

La lluvia que ha arreciado hoy en el circuito checo de Loket ha condicionado la actuación del piloto AMV Jonathan Barragán en la doceava prueba del Campeonato del Mundo de Motocross MX1. Clement Desalle ha sido el ganador del Gran Premio de la República Checa, seguido de Antonio Cairoli, ganador de una de las mangas, y de Rui Gonçalves.

Las adversas condiciones meteorológicas han dejado el circuito muy complicado, donde adelantar era una misión casi imposible. Es por eso que Barragán ha pagado muy caro un mal inicio en la primera manga, en el que ha llegado a ser 16º. Pero con su denuedo habitual ha conseguido adelantar posiciones y finalizar 11º. En la segunda manga la intensidad de la lluvia ha bajado y el piloto AMV seguros  ha tenido mejores sensaciones. Pero a causa de la dificultad del terreno, le ha sido imposible adelantar posiciones y ha concluido en 10º lugar.

Con el décimo puesto de hoy en el Gran Premio de la República Checa, el piloto AMV sigue décimo en la clasificación general y se mantiene entre los diez mejores pilotos del Mundial. La decimotercera prueba del Mundial se celebrará el próximo 21 de agosto con la disputa del Gran Premio de Gran Bretaña en Matterley Basin (Winchester).

En la segunda, he salido mejor y he tratado de tirar, ya que la moto ha respondido bien, a pesar de derrapar en algunas bajadas, pero al final he sido décimo. Mantenemos la misma posición en la clasificación general, pero aún quedan tres carreras y nuestro objetivo siempre es el de mejorar. Nuestra primera oportunidad será en el Gran Premio de Gran Bretaña, en un circuito que me gusta mucho, bastante duro, con mucho agarre, muy parecido a los circuitos españoles".

Voluntarily Lowering the 2012 Workers Compensation Rate Increase is Good News for State Budget

PRLog (Press Release) - Aug 06, 2011 - With so much emphasis on the unemployed and the economic crisis, it’s difficult to think about another crisis-laden group: those injured on the job now eligible for Workers Compensation. The Workers Compensation injury places a burden on the individual, his or her family and the economic crisis in this country.

From Olympia, Washington, Association of Washington Business released the following statement in 2011 regarding the Work Compensation reform agreement reached in the Legislature:

“Today’s announcement is good news for our members who continue to struggle with double-digit rate increases on top of a turbulent economy,” said AWB President Don Brunell. “The governor has told us this Work Compensation package of reforms will lower the 2012 (Workers Compensation) rate increase, and that should provide some much-needed relief from continued year-after-year rate increases. Voluntary settlement agreements have proven successful in several other states – both in terms of helping injured workers and lowering the tax burden on employers.

“Workers Compensation is a critical component of our employment system and a key part of our state’s overall competitiveness. Voluntary structured (Work Compensation) settlements will provide some systemic relief, but this agreement cannot be the last step in the journey toward reform. We must continue to work together – business and labor alike – to find solutions that work for employers and injured employees. Washington state’s Work Compensation system cannot continue indefinitely in its current state – even with the changes reflected in this agreement. And that is a conversation that will need to continue after the gavel falls this spring,” added Brunell.

“We thank the members of the Legislature and the governor for their willingness to address this Work Compensation issue in a bipartisan manner before heading home.”

As this critical Work Compensation economic crisis unfolds in our living rooms, the state legislature must take a stand in the terms of lowering the stress on any state’s budget crisis but not at the cost of our Workers Compensation recipients.

Confused.com finds £4,000 average annual car insurance cost for young drivers

PRLog (Press Release) - Aug 02, 2011 - Confused.com has revealed that car insurance costs for 17-20 year olds have crashed through the £4,000 barrier, with the average 17-20 year old male now paying a staggering £4,006 per year for comprehensive cover.

This is the first time since the Confused.com/Towers Watson Car Insurance Price Index (http://www.confused.com/car-insurance/price-index) began in 2006 that average annual car insurance costs for young men have exceeded £4,000.

Bizarrely, young driver car insurance (http://www.confused.com/car-insurance/young-driver ) costs for males were around £1,000 lower if the driver is married and adds their partner to the policy."

In order to afford a £4,000 a year premium and cover the cost of running a car, the average single male would need to spend £6,500 a year - almost half of the average salary of full-time employees at this age. This effectively prices them out of the market.

There are some modifications to the regulation that are effective 6/27/11 that clarify and expand some of its definitions which can be referenced at: http://www20.insurance.ca.gov/epubacc/REG/157710.htm

1.    There has been confusion as to whether the regulation ONLY relates to Homeowners Insurance or also refers to other types of residential property wherefore a Homeowners Policy would not be written based on occupancy, ownership, or usage but would be written on a Dwelling Program instead based on such eligibility.  The regulation now states:

(1) "Homeowners' insurance policy" shall have the same meaning as "policy of residential property insurance" as defined in subdivision (a) of Insurance Code section 10104

2.   There has been confusion as to whether the regulation applies to mobile homes; manufactured homes; renters; or condominium units.  The regulation now states:

Under section 10104) A "homeowners' insurance policy" does not include:
(A) a tenant's policy;
(B) a policy covering an individually owned mobile home and its contents;
(C) a policy covering an individually owned manufactured home and its contents;
(D) a renter's policy; or
(E) a policy insuring an individually owned condominium unit that does not provide dwelling structure coverage.

3.   There has been confusion as to what an “estimate” actually constitutes and if it would only apply to an actual evaluation based on a company estimator or other resource. This part of the regulation goes to the question as to whether, for example, an insured’s commercial lines broker who is just giving an opinion on his client’s homeowners insurance value although that broker may not be involved in the actual estimation process should be taking the required class and be aware of the regulation.  The regulation is far more broad based then some may have construed and states:

(e) "Estimate of replacement value" shall have the same meaning as "estimate of replacement cost" and means any estimate, statement, calculation, approximation or opinion, whether expressed orally or in writing, regarding the projected replacement value of a particular structure or structures.

4.   Last but NOT least all Broker/Agents must be in compliance with Section 2695.182 for documentation.  All individuals working with residential properties must review this section to set standard in their agency to comply with the regulation.
