Prior to these positions, Mr. O’Connor served in various legal and claims management positions including trial counsel & attorney of record in an active Long Island, New York practice. Charlie was also instrumental in the development of litigation management efforts for the Liberty Mutual Group.
Mr. O’Connor obtained his J.D. from St. John’s University School of Law in New York. He is a member of the New York State Bar, the American Bar Association and the Defense Research Institute.

HSA for America Educates the Public on How to Use the New Expanded IRA – a Health Savings Account

While HSA Plans carry the same tax-free-earnings benefit and the tax-deduction advantage to lower taxable income that IRAs do, HSA Plans don’t limit those benefits to people under 65.  HSA Plans allow seniors to keep their investment growing with tax-free earnings and to continue deducting HSA contributions to reduce taxes.

By removing the limits on preventive health care and the under-65 age restriction for IRA-like tax advantages, HSA Plans have become so attractive that consumers are doubling up with a second HSA.  The IRS allows individuals to have multiple Health Savings Accounts, so consumers may combine an investment-oriented HSA with a cash-based one to be used for current health care expenses.  

The original HSA provides tax-free distributions to pay for qualified health care expenses without any restriction on age.  The second HSA acts as a pure investment option.  Unlike an IRAs or a Roth, which require seniors to start withdrawing funds, an HSA lets them continue growing their retirement account with tax-free earnings.  

HSA Plans offer investment options that rival IRAs, such as bonds, no-load mutual funds or stocks.  Interest-earning savings accounts are another option.  Pre-65-year-olds are penalized for withdrawing funds to be spent on anything other than qualified health care, but after 65, there’s no penalty for withdrawing HSA funds regardless of how the money is spent.  Taxes are still due on withdrawals, though.

One Fifth Of Long Term Care Insurance Claims Result Of Alzheimer's

PRLog (Press Release) - Aug 31, 2011 - Approximately 200,000 Americans receive benefit payments as a result of owning long term care insurance and a new study reveals the top causes of requests for claims.

"Insurers paid out $6.1 billion in benefit payments last year," states Jesse Slome, director of the American Association for Long Term Care Insurance.  "The majority of new claims are for care in the policyholders own home or in an assisted living community."  Nursing home care accounts for about one in four new individual claims.

A new report issued by the Society of Actuaries examined the causes or reasons for new claims.  "Nearly one in four claims was initially attributable to Alzheimer's disease," Slome who is one of the nation's leading long term care insurance experts explains.  

Roughly one-in-10 new claims was the result of one of four conditions: stroke (9%), arthritis (9%), injury (9%) or circulatory problems (9%).  Other causes for claims were cancer (8%), nervous system (6%) or respiratory issues (5%).

Claims against long term care insurance policies tend to be initiated at older ages typically after one reaches age 80.  "People in their 50s and 60s may require long term care as a result of an injury," Slome adds.  "You'd be surprised how many men fall off roofs or out of trees and take eight or nine months to recover."

While most typically don't need long term care until older ages, the Association recommends planning begin between the ages of 52 and 64.  "That is the best age to start planning because costs are lowest and you don't risk being declined because of existing health conditions," Slome explains.  "After Medicare kicks in people start seeing more doctors and their diagnosis can be the cause of an outright decline for this protection."

elephant.co.uk reveals Scottish drivers like to make it personal

PRLog (Press Release) - Sep 02, 2011 - Motorists living in Scotland are the most likely to own a personalised numberplate new research by elephant.co.uk has revealed. And the plates are odds-on to be seen adorning the bumpers of luxury cars such as Bentleys, Ferraris and Aston Martins.

Car insurance (http://www.elephant.co.uk/ ) specialist elephant.co.uk looked at 3.5 million policies and found that of the top 10 postcodes where personalised plates are popular, eight are in Scotland, with the affluent settlement of Kilmacolm in Inverclyde at the top of the list. 14% of drivers there own a personalised plate compared to a national average of 4%.

In second place we move to the other end of the country to the millionaire’s playground of Sandbanks in Dorset (13%), but then in third place it’s back up north with the prosperous Glasgow commuter area of Newton Mearns (12%). Also in the top 10 are a number of postcodes in and around Aberdeen, with North Ferriby in Humberside joining Sandbanks as the only other location outside of Scotland.

Brian Martin, managing director of elephant.co.uk, said: "Considering the affluent areas around the country where we see the highest proportion of personalised number plates, it certainly looks like they’re used as a status symbol.

"However, it's hard to say why they’re so popular in Scotland specifically. Maybe Scottish motorists look to express their individuality more than those in the rest of the UK."

When it comes to what cars the personalised plates appear on, it's perhaps no surprise that owners of luxury models are the most likely to splash out on them. In fact, the whole top 10 list is made up of prestige motors. Most popular is the Bentley Continental, with 36% carrying a personalised plate. This is followed by the Ferrari 360 and Aston Martin DB7 (both on 35%).

Brian continued: "It wasn’t a surprise to see that prestige models dominate the list, however, it was surprising to see that such a large number of Bentley Continental, Ferrari 360 and Aston Martin DB7 owners splash out on personalised plates. Drivers of those cars definitely want to stand out from the crowd."

When it comes to occupations, elephant.co.uk found that Company Chairmen are head and shoulders above the rest with 16% owning one, followed by Bank Directors on 12% and Property Developers on 11%.

elephant.co.uk also looked at those areas, occupations and vehicles with the lowest percentage of personalised plates. The Hilborough and Northwold area near Thetford, Norfolk was revealed as the area of the UK with the lowest percentage of cars with personalised numberplates, croupiers were the occupation at the bottom of the list whilst the Suzuki Liana is the vehicle least likely to have one attached to it.

According to the New Jersey Division of Consumer Affairs, New Jersey’s price gouging law automatically activated when Gov. Christie declared a state of emergency. The law deems price increases excessive if they are more than 10 percent higher than the price at which a good or service was sold in the usual course of business prior to the state of emergency.

Ten tips to avoid getting scammed:

1.   Take your time in choosing true professionals to repair your home.

2.   Get estimates from several licensed, bonded contractors.

3.   Check their credentials with the New Jersey Division of Consumer Affairs or your local Better Business Bureau.

4.   Inspect contractors’ licenses and proof of liability insurance.

5.   Get a contract or estimate in writing.

6.   Avoid paying money up-front. Some reputable contractors will require partial, up-front payment, but these pre-work payments should not exceed the cost of materials or 20 percent of the total estimate.  

7.   Follow local building codes and inspection procedures.

8.   If anyone performs unauthorized work on your house or property and demands payment, consider contacting local authorities.

9.   Do not sign over an insurance settlement check to the contractor.

10.   Immediately report any suspicious behavior to local law enforcement or the New Jersey Division of Consumer Affairs.

Confused.com finds UK drivers are divided on government's new roadworks idea

PRLog (Press Release) - Aug 31, 2011 - Confused.com has polled 2000 drivers, asking their opinions on a new idea from the UK government which could help tackle the problem of roadworks and the resulting traffic jams. The proposal suggests that utility companies could pay a 'lane rental' fee to the council if they choose to dig up the road during busy times*.

UK motorists are divided on the proposal with almost half(49%) saying it's a good plan and that they can't wait to see it happen and the other half (48%) feeling that it's not a good idea because utility companies who choose to pay the bills will pass these costs onto the consumer. The remainder were undecided.

Gareth Kloet, Head of Car Insurance at Confused.com said: "If these proposals reduce traffic jams then car owners will have something to smile about. Financially it’s been a tough few years for drivers. Consumers are paying an average of £858 for annual comprehensive cover, having seen an increase of £22 in just three months and £170 over 12 months**. Car owners really deserve a break and roads that run freely will be welcomed by anyone regularly blighted by queues.

"The 'lane rental' fees could be a good incentive for companies to complete  jobs more quickly reducing the potentially dangerous and infuriating situations that roadworks can create."

Lisa Greenfield, Energy expert at Confused.com added: "With UK energy companies having recently hiked up their prices, the last thing that customers want is any sort of extra 'tax' which may end up being paid by the customer. If this proposal goes ahead then UK households will be hoping that utility companies choose to work outside of peak hours and not pay the charges because any further hikes in utility costs would be unpleasant.".

Regionally, Londoners are most in favour of the plans with more than 52% agreeing that they are a good idea.

Read How Tree Selection and Location Influence Tree Risk Assessment in the Urban Area

Due to the close proximity of trees in the urban landscape, tree failures often result in personal injury and/or property damage.  What the cause or why a tree failed is an important factor in tree accidents and related lawsuits.  

The damage caused by a tree part or whole tree failure resulting from an extreme climatic event such as a hurricane or tornado may be viewed and defended as an "Act of God", a natural, unavoidable or unforeseeable catastrophe that interrupts to expected course of events.  However, with increased understanding of tree mechanics, biology and structure, tree hazards and inherent risks can be identified and a prescribed course of action can reduce the tree risk.

Property owners are liable for the trees on their property.  It is an owners' legal "duty of care" to properly inspect and ascertain if their trees may be causing a foreseeable problem or risk.  When an owner identifies a possible hazardous tree condition, they recognize their responsibility to have a tree professional perform a tree risk assessment.

Tree risk assessments are undertaken when an owner recognizes that their tree(s) have potential to cause damage or injury.  The assessment is intended to:

• limit the amount of risk to people in the vicinity of trees.
• limit the amount of risk to important property in the vicinity of trees.
• limit the amount of risk associated with owning trees.
• identify the highest risk trees that require immediate attention.
• recommend actions required to reduce the risk to an acceptable level.

Mr. Rappoport writes about the importance of tree selection and location in the urban landscape, and how a good tree in the wrong location can become a "risky" tree as it ages and matures.  

"Far too often, the tree selection fails to properly match the cultural growth requirements of a tree with the correct location. Somewhat like trying to pound a square peg into a round hole. Since trees are long-lived organisms, the growth characteristics that make a tree unsuitable for a location do not manifest for ten or twenty years.

Homeowners typically make the mistake of not understanding the growth characteristics of trees. Or, they assume the tree wiil not be around twenty or thirty years later. So, a small pine tree planted near the neighbors property line doesn’t become a problem until two decades later when the tree roots encroach into the neighboring residence and the tree crown extend over the property line. These conditions create tree hazards that increase the risk and potential liability to property owners. "

QUINN-direct Nationwide Survey Reveals a Number of Intersting Stats

PRLog (Press Release) - Aug 09, 2011 - One in three people admit to being a passenger in a car while the driver was under the influence of drugs or alcohol, QUINN-direct nationwide survey finds

A nationwide survey of 1000 adults commissioned by QUINN-direct Car Insurance Ireland has revealed that over a third (36%) of Irish people has been a passenger in a car where the driver was under the influence of drugs or alcohol. Males, those aged 45+ and living in Connaught or Ulster are most likely to be the offenders.  People aged 35-44 and living in Dublin were least likely to be under the influence of drugs and alcohol.

The survey found that one in five people admit to having driven a car while under the influence of drugs or alcohol. Once again, this figure is significantly higher amongst men (28%) and those over the age of 45 (26%). Women (10%) and people aged 16-24 (7%) were least likely to have driven under the influence of drugs or alcohol.  Munster people were more likely than those in any other province to have driven while under the influence (21%).

Almost three quarters of the Irish population have experienced anger or rage while driving
The research, which tested Irish people’s attitudes to driving and their driving habits, highlighted that the majority of Irish drivers (71%) experienced anger or rage whilst driving. A large percentage of men (78%) say they have experienced rage or anger behind the wheel and a significant percentage of women felt the same (64%). Incidences of rage are highest amongst those aged 24-44 but affected people around the country irrespective of location.

Over a half of Irish adults continue to use their mobile phone whilst driving
Over half (52%) of Irish adults said they used their mobile phone while driving to make or receive calls (without the use of a headset/bluetooth). Females were slightly more likely (34%) than men (32%) to use their phone while driving and those in the 35-44 age group were most likely to be the offenders (64%).

Two thirds of Irish drivers have broken the speed limit in the last 12 months
Two thirds of Irish drivers admit to having broken the speed limit in the last 12 months (66%). 75% of men and 66% of females admitted they had broken the speed limit – 73% of those in Munster compared to 64% in Connacht and Ulster, and 65% in Dublin. Those aged between 35 and 44 were most likely to have broken the speed limit.

1. Don't use your mobile phone whilst driving
Making or receiving a call, even using a hands-free phone, could lead to an accident.

2. Belt up in the back
In a collision, an unbelted rear seat passenger can kill or seriously injure the driver or a front seat passenger.

3. Alcohol, drugs and driving
Alcohol and both illegal and prescription drugs (including cold remedies) can impair your driving. It is never ok to drive when you have taken drugs. Be a safe driver and don't drink and drive.

4. Slow down
Take extra care outside schools and parks and other places where there may be more pedestrians around. Don’t forget children often act impulsively and many will be “trick or treating” this Halloween.

5. Take a break
Tiredness is thought to be a major factor in more than 10% of road accidents. Plan to stop for at least a 15 minute break every 2 hours on a long journey this bank holiday.

6. Anticipate
Observe and anticipate other road users. Use your mirrors regularly and don't forget to glance into your blind area before altering your course.

7. Use child seats
Child and baby seats should be fitted properly and checked every trip.

8. Keep your distance
Always keep a safe distance from the car in front.

9. Check your tyres
With the weather changing, it is important to ensure that your tyres are roadworthy for winter.

Changes to NJ PIP Auto Insurance System Under Consideration

The changes would stop the use of ''diagnostic tests or practices that are not from evidence-based, clinical guidelines published in peer-reviewed journals.'' The legislation is based on sound logic. Breakdown Britain - Mortorist Shun Car Safety

PRLog (Press Release) - Aug 09, 2011 - Almost four out of ten (39 per cent) motorists do not know how to carry out any basic vehicle safety checks, reveals a survey out today by Quinn-direct, the young drivers insurance specialist.

The research reveals that out of the seven most common warning lights on a car dashboard, a staggering 65 per cent of motorists wouldn’t recognise any of them. This is particularly disappointing given that almost a quarter (22 per cent) admit that they don’t carry their vehicle handbook in the car with them.

Breakdown Britain’s top motoring mishaps include:

•   A quarter (23 per cent) of motorists don’t know how to check their car tyre treads
•   One in five (20 per cent) wouldn’t recognise the engine warning light if it came on
•   Almost one in five (18 per cent) don’t know how to check their tyre pressure
•   16 per cent of motorists don’t know how to check that their engine oil level is correct.

Given the low level of knowledge about warning lights and general car maintenance, it is disappointing that one in five (20 per cent) of UK drivers do not have breakdown cover. Cheap car insurance for young drivers may often contain certain cover so it’s always worth checking your policy first.

Men tend to be more switched on than women when it comes to knowing how to repair their cars – 80 per cent of women said that they have no idea how to carry out any safety checks or basic maintenance on their cars, compared to just 36 per cent of men.

Older is not necessarily wiser - almost a third of over 55s (30 per cent) say that they don’t think that they need breakdown cover, compared to only 16 per cent of 25-34 year-olds.

John McDonagh, Head of Consumer Insurance at Quinn-direct, said: “It is concerning that so many motorists do not know how to carry out basic vehicle safety checks and are unaware what the various vehicle warning lights mean.
